Terms of Service

1. Acceptance of terms

By creating an account or using BorrowerDocs ("Service"), you agree to these Terms of Service ("Terms"). The Service is operated by BYTEPAIR LLC. If you are using BorrowerDocs on behalf of a business, you represent that you have authority to bind that business to these Terms.

2. Description of service

BorrowerDocs provides a software-as-a-service platform for independent mortgage brokers to collect documents from borrowers via a branded portal, manage document checklists, communicate through in-portal Q&A, and export completed document packages. BorrowerDocs is a technology tool, and it is not a lender, mortgage broker, or financial advisor.

3. Accounts and eligibility

  • You must be at least 18 years old to create an account.
  • You are responsible for maintaining the security of your account credentials.
  • You must provide accurate information when creating your account.
  • One account per person; you may not share accounts.

4. Acceptable use

You agree not to:

  • Use BorrowerDocs for any unlawful purpose or in violation of any applicable laws.
  • Upload malicious files, malware, or content designed to harm others.
  • Attempt to gain unauthorized access to our systems or another user's data.
  • Resell or redistribute access to BorrowerDocs without authorization.
  • Use the service in any way that could damage, disable, or impair BorrowerDocs.

You are responsible for ensuring that your use of BorrowerDocs complies with all applicable mortgage industry regulations, including those governing the collection and storage of borrower information.

5. Your content

You retain ownership of all documents and content you or your borrowers upload to BorrowerDocs ("Your Content"). By uploading content, you grant BorrowerDocs a limited license to store, process, and display Your Content solely to provide the Service to you.

You represent and warrant that you have all rights necessary to upload Your Content and that doing so does not violate any applicable law or any third party's rights.

6. Plans and billing

  • Plans and pricing are as displayed on the BorrowerDocs pricing page at the time of subscription.
  • Paid plans are billed monthly or annually in advance.
  • You may cancel at any time; your access continues until the end of the billing period.
  • We do not offer refunds for partial billing periods except where required by law.
  • We reserve the right to change pricing with 30 days' notice to current subscribers.

7. Service availability

We aim for high availability but do not guarantee uninterrupted access. We may perform scheduled maintenance with advance notice. We are not liable for any losses resulting from downtime or service interruptions beyond our reasonable control.

8. Termination

Either party may terminate the agreement at any time. We may suspend or terminate your account immediately if you violate these Terms. Upon termination, your access to the Service ends. You may export your data before termination using the file export feature. To request deletion of your account data following termination, contact [email protected].

9. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BORROWERDOCS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

11. Governing law

These Terms are governed by the laws of the State of Florida, without regard to its conflict of law provisions. Disputes shall be resolved in the courts of Florida.

12. Changes to these terms

We may update these Terms from time to time. We will notify you of material changes by email or prominent notice in the app. Continued use of BorrowerDocs after changes take effect constitutes acceptance of the revised Terms.
